Welcome to DIGITALSKY. By accessing or using our platform, you agree to be bound by these Terms of Service. If you do not agree, please do not use our services. DIGITALSKY connects businesses and individuals ("Clients") with vetted agencies and freelancers ("Providers") for digital projects.
"Platform" refers to the DIGITALSKY website and all associated services. "Client" means any user who posts a project brief or seeks services. "Provider" means any agency or freelancer who offers services through the Platform. "Project" means any work engagement initiated through the Platform.
You must create an account to use certain features of the Platform. You are responsible for maintaining the confidentiality of your login credentials and for all activity under your account. You must provide accurate, current, and complete information.
We reserve the right to suspend or terminate accounts that violate these Terms or engage in fraudulent, abusive, or illegal activity.
Providers represent that they have the skills, licenses, and authority to perform the services they offer. All portfolio submissions must accurately represent the Provider's own work.
Providers agree to respond to briefs in a timely manner and to deliver work that matches the scope agreed upon with the Client. Failure to do so may result in removal from the Platform.
Clients agree to provide clear, accurate briefs and to communicate in good faith with Providers. Clients must not use the Platform to solicit work and then circumvent the Platform to avoid fees.
DIGITALSKY may charge fees for certain services, including but not limited to project success fees or featured listing fees. All fees will be clearly disclosed before they are incurred. Payment terms are governed by our separate Payment Policy.
Upon full payment, the Client receives full ownership of the deliverables created by the Provider, unless otherwise agreed in writing. Providers retain the right to display work in their portfolio unless a confidentiality agreement prohibits it. DIGITALSKY claims no ownership over user-generated content posted on the Platform.

The Platform is provided "as is" without warranties of any kind, either express or implied. DIGITALSKY does not guarantee that the Platform will be uninterrupted, secure, or error-free. We are not responsible for the quality, safety, or legality of services provided by third-party Providers.
To the maximum extent permitted by law, DIGITALSKY shall not be liable for any indirect, incidental, special, or consequential damages arising out of or in connection with your use of the Platform, including but not limited to lost profits or business interruption.
Either party may terminate these Terms at any time by discontinuing use of the Platform. DIGITALSKY reserves the right to terminate or suspend access to the Platform immediately, without prior notice, for any breach of these Terms.
We may update these Terms from time to time. Changes will be posted on this page with an updated "Last updated" date. Continued use of the Platform after changes constitutes acceptance of the new Terms.
